International Criminal Tribunal for Victims
Establishment of the International Criminal Victims' Victim Assistance Fund is an innovative step in the founding states of the Court to ensure that genocide, crimes against humanity and victims of war crimes play an important role in research for international justice. Unlike the Court, which is now accused of committing crimes against people who have been punished for committing crimes against humanity, the Fund is not well-known to the general public. The following article contains information on the establishment, mandate and operation of the International Fund.
The Rome Statute of the International Criminal Court, which has now been certified by more than 100 countries, came into force on 1 July 2002. This paragraph is contained in:
79. Article 1 (1), to be adopted by the General Assembly of States Parties for the benefit of the victims of criminal offenses under the jurisdiction of the Court and for the families of such victims.
In addition to this provision, the Victim Trust Fund was established on September 9, 2002 at the 3rd plenary session of the General Assembly of States Parties to the Rome Statute. The Statute, detailing its mandate and details of its operation, was adopted on 3 December 2005 at the 4th plenary session. The Fund was fully operational in 2007 and completed its full operation in 2008.
The Fund is managed by a board of directors consisting of prominent people worldwide, different citizens and a fair geographical representation, the composition of the body. The Fund's decision in 2002 contains the following criteria for Board membership:
The members of the Board of Directors are of a high moral, impartial and integrity nature and have the power to assist victims of serious crime.
To assist the day-to-day operation of the Fund's Directorate, a secretariat was set up in 2004 and became fully operational on 31 January 2007 by appointing an Executive Director. The Fund is a unique institution in international law. It is also different in its relationship with the International Criminal Court. Adopt the Trust Fund Decree to establish an institution that is largely self-employed and is subject to full supervision and management by the Board of Directors. At the same time, the Fund is closely linked to the Court of Auditors: its operations are linked to cases and regions in the Court's case law; has institutional relations with the Court of Auditors' register for which it serves administrative purposes, as well as chambers which, in addition to the Fund Regulations, should be informed of the Fund's intention to provide aid projects and never award compensation to be paid by the Fund.
Although originally conceived as a mechanism to implement repair agreements issued by the Court (the trial has not yet been completed and no compensation order has been issued), negotiations between States Parties will be resolved by a second mandate. The Statutes mandate to act independently (albeit a notice to the Court of Auditors to ensure that no action affects the ongoing litigation) to assist the victims before the court judgment is delivered.
The Trust Fund provides for such assistance in a single case when "the Board considers it necessary to provide physical or psychological rehabilitation or financial support for the benefit of the victims and their families" (Article
territorial operations.These operations were initially restricted to the Democratic Republic of Congo and Uganda with the intention of moving to Central Africa and Sudan (Darfur), which is not funded by humanitarian agencies but is intended to assist, if they deem it necessary and strictly linked to the criteria set out in the regulations, due to the difficulties experienced by the victims in the case law of the Court of Justice. rehabilitation and reintegration of child soldiers, including girl warriors and abducted families in family reunification, placement and support for independent living;
o Improving access to reproductive health services, counseling and psychological support for victims of rape;
o Provides opportunities to improve household livelihoods through agricultural and microcredit initiatives.
Report to the General Assembly of States Parties on the Activities and Projects of the Victim Assets Board for the period 1 July 2007 to 30 June 2008.
The resources of the Fund, which are still relatively limited at this point, come from different sources, including public and private donors.
